Agreement to Terms

By accessing or using DigitRaver ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

Description of Service

DigitRaver is a live DJ streaming platform that allows performers to broadcast live music performances and viewers to watch these performances via mobile applications and web browsers.

Eligibility

You must be at least 13 years old to use DigitRaver. If you are under 18, you must have permission from a parent or guardian.

User Accounts

Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account

Account Types

  • Raver Account: For viewers who want to watch live performances
  • Streamer Account: For DJs/performers who want to broadcast performances (requires additional agreement to Artist Agreement)

User Conduct

You agree NOT to:

  • Upload illegal, harmful, or copyrighted content
  • Harass, abuse, or harm other users
  • Impersonate others or misrepresent your identity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to the platform
  • Use automated systems (bots) without permission
  • Violate any applicable laws or regulations

Content

User Content

  • You retain ownership of content you create
  • By uploading content, you grant DigitRaver a license to distribute and display it
  • You are responsible for ensuring you have rights to all content you upload
  • We reserve the right to remove content that violates these terms

Prohibited Content

  • Copyrighted material you don't have rights to use
  • Illegal, obscene, or harmful content
  • Content that violates others' rights
  • Spam or misleading content

Intellectual Property

  • DigitRaver and its logos, features, and functionality are owned by DigitRaver, Inc.
  • You may not use our trademarks without prior written permission
  • All rights not expressly granted are reserved

Payments and Subscriptions

For Performers

  • Payment terms are governed by the Artist Agreement
  • Monthly payouts require minimum threshold of $3
  • Payments processed via PayPal
  • We reserve the right to withhold payment for fraudulent activity

For Users

  • The app is currently free to use
  • We reserve the right to introduce paid features in the future
  • Any future pricing changes will be communicated in advance

Termination

By You

  • You may delete your account at any time through the app settings

By Us

We may suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent activity
  • Fail to perform scheduled streams (for performers)
  • Violate our Content Guidelines

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • Uninterrupted or error-free service
  • Accuracy or reliability of content
  • Specific results from using the service

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITRAVER SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or goodwill
  • Service interruptions or data loss
  • Actions of other users

Maximum liability is limited to the amount you paid us in the past 12 months (if any).

Indemnification

You agree to indemnify and hold harmless DigitRaver from any claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of others' rights
  • Your content

Privacy

Your use of the Service is also governed by our Privacy Policy.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via:

  • In-app notification
  • Email (if provided)
  • Website announcement

Continued use after changes constitutes acceptance of new terms.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the United States.

Arbitration

Any disputes will first be attempted to be resolved through informal negotiation. If unresolved, disputes will be settled through binding arbitration.

Class Action Waiver

You agree to resolve disputes individually, not as part of a class action.

Miscellaneous

Entire Agreement

These Terms, along with the Privacy Policy and Artist Agreement (for performers), constitute the entire agreement.

Severability

If any provision is found invalid, the remaining provisions remain in effect.

No Waiver

Failure to enforce any right does not waive that right.

Assignment

You may not assign these Terms. We may assign them without restriction.

Special Provisions

AR and Camera Features

  • Camera access is required for AR avatar features
  • All facial tracking is processed locally on your device
  • No video feed is uploaded or stored
  • You can disable AR features at any time in settings

Beta Testing

  • The app may include beta features that are experimental
  • Beta features are provided "as is" with no guarantees
  • We may discontinue beta features at any time

Force Majeure

Neither party is liable for failures due to circumstances beyond reasonable control, including:

  • Natural disasters
  • Acts of war or terrorism
  • Internet service provider failures
  • Server outages
  • Government actions
